Judgment And Order

Petitioner Mrs. Ponung Boring,DPO, Pasighat and the respondent Mr. U.K. Deb, Post Master, Pasighat are present. We have heard the parties.

            The petitioner has submitted that she had filed this application on 23/10/2001 before this Consumer Forum for initiating action against the Postal department for non delivery of registered letter vide registration No.9330 dated 4/07/2007 to DC, Tezu. The said letter pertained to Utilization Certificates of  MPLAD Schemes. Utilization Certificates are forwarded by the concerned DC to the DC, Tezu who is the Nodal Officer for such schemes who in turn forwards the same to the Govt. of India for releasing of next installment of MPLAD fund. She has stated that due to non delivery of the said registered letter, the District Planning Officer, Tezu vide his letter No. PLG/KPLADS/ LS/43/2007-08 (Vol-IX) dated 16/08/2007 had written to DC, Pasighat to resubmit the Utilization Certificates. Hence, this case. In support of this, she has furnished a copy of the letter herein referred before.

            On the other hand, Mr.U.K Deb, Post Master, Pasighat who is respondent has submitted that no cause of action lies in the matter as said letter had been duly receieved by DC,Tezu on 12/07/2007. He has furnished a copy of the dak challan wherein the said registration appears at seriel no. 10 and it is seen that the said letter was receipt at DC Office, Tezu on 12/07/2007. In view of this, the respondent has submitted that the case needs to be closed and disposed off.  

            Upon hearing of the parties, we are convinced and satisfied with the submission made by the respondent. For, it was because of the negligence of the DPO office, Tezu that the communication had been made from their side. In view of this, the present application stands disposed off and closed. No cost.
