Today is fixed for filing show cause by the complainant, i.d., necessary order will be passed.
Today no step taken by the complainant. None appears on behalf of the complainant during its call. No show cause is filed by the complainant. Ld. Counsel for the OP -2 appears by filing hazira.
It is evident from the records that the complainant filed this complaint with a prayer for refund of Rs. 75,000=00 as maturity amount from the OP along with compensation and interest on the above mentioned maturity amount as the Ops lost the certificates after deposited by the complainant for its maturity amount.
It is also evident from the record that the OP-2 to by supplying Pass Book in lieu of Lost/Destroyed savings certificate (s) directed the OP-2 to deliver the Pass Book on proper identification. The said letter shows that the complainant-Jinnatun Nahar Gulshan Begum received the duplicate NSCs (Passbooks) of Rs. 75,000=00 on 23.02.2019 by putting her signature. The said fact has been corroborated to the OP-2 -Senior Superintendent of Post Offices by the OP -1 through letter dated 23.02.2019.
Today the complainant is absent without taking any step and no show cause is filed on her behalf. We are of the opinion that the complainant is not willing to proceed with the complaint further as the complainant has received the duplicate NSC (Passbooks) amounting to Rs. 75,000=00 as maturity amount. Therefore, she is not taking any step to proceed with the complaint. So, we are of the view that the present complaint should be dismissed for default.
Hence, it is
O r d e r e d
that the present Consumer Complaint being No. 124/2018 be and the same is dismissed for default due to non-prosecution. There is no order as to costs.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
