Today is fixed for Return of Service, Appearance with Written Version.
OP No.2 appeared today by Mr. Abhijit Pal,P.A , Katwa H.P.O and files a bunch of documents in relation to application for issuance of declaration in lieu of lost/destroyed N.S.C and application dt. 24.03.15, Indemnity Bond and official letters in relation to issuance of duplicate certificate of NSC by the SPMs Katwa and Kalna. After perusing the documents , it appears that Sr. Superintendent of Post Office, Burdwan Division, Burdwan by a letter dated nil, requested to refer the office of issuance of duplicate certificate vide this office letter No. R-163/Dup/NSC./Ktw/01/03/15 dt. 26.03.2015 at Burdwan and also requested to appear before this Forum.
In reference to the above letter the Post Master, Katwa HPO by a letter dt. 6.04.15 informed the Sr. Superintendent of Post, Burdwan Division, Burdwan that he has already delivered the duplicate certificate to SPM Kalna through a messenger on 28.3.2015 and SPM Kalna intimated that payment was made by cheque No. 341530 dt. 01.04.15 amounting to Rs.49, 512/- to Mahuya Chattopadhyay, the complainant herein.
The complainant by filing a verified petition informed this Forum that she received the cheque from OP No.1 as full and final satisfaction and she is not interested to proceed with the case as the dispute has already been settled and for this she prays to dismiss the case due to non-prosecution.
In this circumstance, after perusing the petition and documents filed by the parties, we are in a considered opinion that the grievance of the complainant has already been settled. So there is no impediment to dispose of the case on full and final satisfaction.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under registered post with A/D to the concerned parties as per rules, for information and necessary action.
