O R D E R SRI.K.T.SIDHIQ,PRESIDENT Complainant Mohanan made a proposal to join in Postal Life Insurance Scheme facilitated by the postal authority i.e the opposite party and paid the first premium on 26-03-2007 in Mulleria post office. As assured, the policy of insurance and the pass book ought have been issued to him within 3 months. But it was not done inspite of his repeated attempts to obtain it. Hence the complaint for getting the Postal Life Insurance Policy along with compensation for the mental agony he suffered. 2. The notice was issued and the Post Master General, Trivandrum entered appearance and filed the version. 3. According to the Superintendent of Post offices, Kasaragod Division, Kasaragod who filed written version on behalf of the opposite party, Post Master General, the postal life insurance proposal canvassed during the month of March 2007 and the proposal was kept in the office after medical examination for despatch to circle office, Trivandrum. This could not be forwarded to circle office as it was left behind inadvertently. However, the same was forwarded on 11-04-2008 and it was returned by circle office to get fresh medical opinion and to get certain omissions supplied. As Sri.Mohanan was crediting the premium amount regularly the proposal was resubmitted to circle office on 26-05-08 with fresh medical opinion and after supply of certain omissions. The policy document No.KL-78675-CS and the premium receipt book had been received from circle office on 09-06-08 and delivered to Mohanan on the same day. Eventhough there was some delay for issuing the documents due to omissions in the proposal form in time the risk of his life has been under written with effect from 26-03-07 itself. 4. Mohanan examined as PW1 and Exts A1 to A3 marked. He states that he paid Rs.400/- towards first premium and there after continued to pay Rs.400/- towards the premium. But after receipt of policy and premium he came to realise that the premium is Rs.355/-only and a rebate of Rs.5/- was declared in the month of April 2007 itself. He had paid Rs.400/- till June 2008 and the fact of rebate was not informed to him. He also submits that only after filing the complaint he received the policy postal Life Insurance Policy and premium receipt book. 5. On an appraisal of the facts circumstances and the evidence tendered before us it is clear that this is a best example of grossest deficiency in service on the part of Post Master General, the opposite party herein. It is also clear that only after filing the complaint before the Forum complainant received his Postal Life Insurance Certificate and premium receipt book. This is nothing but the callous negligence of the opposite party. Due to the delay in issue of the PLI policy, Mohanan has to pay excess amount towards premium since April 2007 till June 2008. 6. Definitely Mohanan is entitled to get compensation from Post Master General, Trivandrum for the deficient service rendered to him. Therefore we allow the complaint and the Post Master General, Trivandrum is directed to pay Rs.2000/- towards compensation for the loss, hardship and mental agony suffered by Mohnanan on account of delay in receiving the PLI policy and premium receipt and also towards the refund of excess premium he paid towards the premium from April 2007 to June 2008. Post Master General, Trivandrum also directed to pay Rs.1000/- towards the cost of this proceedings. Time for compliance is limited to 30 days from the date of receipt of copy of order.
