                                J u d g e m e n t.

        The  present disputes emerges out of the grievance raised in the  complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for non issue of  P.L.I  policy bond and pass book inter alia  to receive the policy amount  for the year 2015 and 2016.

       2) On being Noticed to the O.Ps the O.P. No.2 appeared  in person before the forum  and stated that being the operational head of Koraput postal Division is competent  to file the reply on behalf of all the   O.Ps   inter alia filed   written  version refuting the allegation made against them. The O.Ps taking one and other grounds in the written version   sought to dismiss the complaint as it is not maintainable  under the C.P. Act, 1986. The facts which are not specifically admitted may be treated  as denial of the O.Ps. Hence the O.Ps  prays the forum to dismiss the case against  them  to meet the ends of justice.

The O.Ps appeared and filed their written version.  Heard arguments from the    O.Ps and from the complainant.    Perused the record, documents, written version  filed by the parties. 

The  parties advanced arguments vehemently opposed the complaint touching the points both on the facts  as well as on  law.

                                                         FINDINGS.

On perusal  of the  written version filed by the O.Ps it is revealed that  there is no dispute  the complainant  had submitted proposal form for opening of a Rural postal life insurance policy  to the  Branch Postmaster, Khilingrai branch post office  in account with Padmapur Sub-post office  inter alia an  amount  of Rs.6,870/- was deposited by the  complainant   towards first premium of the RPLI policy  on the date   of proposal i.e. on Dt. 18.2.2014 and a valid receipt was granted to him by the  O.P. No.4.   In conjunction with departmental modus operandi, the  O.P. No.4 forwarded the proposal form to the  O.P. No.3for necessary verification. The O.P. No.3  forwarded the proposal form to the  O.P. No.2  which was received by the O.P. No. No. 2 on  Dt. 5.5.2014.  The O.P. No.2 issued  policy documents to the complainant  policy bond No.  R-OR-EA-711813 on Dt. 17.7.2014.  The policy bond and policy receive book was sent by the O.P. NO.2 to the complainant vide Registered Letter No. RO556275910 IN  Dt. 22.7.2014.   The said Registered letter containing policy documents  had since been  delivered correctly to the complainant   on Dt. 28.7.2014  (the copies of   acknowledgement   towards receipt of documents  by the  complainant  is filed  which is marked  as Annexure-I.)

The forum is not inclined to carry the O.P. to  a legal  nor does  feel  that  after a remedy for the grievances has already been made  as to the complainant in this case continuing the proceeding further  would  serve  any  judicial ends. Mere a frivolous  assumption  of loss and damage  can not make any law  instaneously    dock the O.Ps  to gallows. 

This forum observed the O.P. after receipt of notice from the Forum promptly  delivered the  P.L.I  policy bond and pass book to the complainant  and there is no deficiency in service on the part of the O.P.  The present case in hand the complainant is not entitled any compensation from the O.P.

                          

ORDER.

In resultant it is ordered  the case stands disposed off.  There is no order as to cost and compensation.
