Learned Counsel appearing for the Complainant submits that as per his instructions, if the Petitioner is willing to comply with the directions issued by the Fora below, the Complainant would not object -2- to the setting aside of finding by the Fora below to the effect that the subject vehicle had inherent manufacturing defect. In view of the above submission, we dispose of the Revision Petition with a direction that the Complainant shall send the subject vehicle to the designated workshop of the Petitioner, on intimation to him for the date and time to be mutually fixed, for rectifying the defects, pointed out in the report dated 22.01.2015, submitted by the team of Experts, to the District Consumer Disputes Redressal Forum, Panchkula. It is agreed that after the necessary repairs are carried out, the vehicle shall be re-inspected by a team of Experts to be nominated by the Head of Mechanical Engineering Department, Punjab Engineering College and University of Technology at Chandigarh after due notice to the Complainant. If the members of the earlier team are still available, the Head of the Department may consider nominating them again for the afore-said purpose. The team of Experts shall be paid by the Petitioner, by way of remuneration, the amount, which was paid at the time of first inspection. If the team of Experts certifies that the vehicle is now free from the defects, as pointed out in the afore-noted report, the Complainant shall take its delivery. The amount of compensation, as awarded by the Fora below shall be remitted directly to the Complainant within four weeks from the date of receipt of a copy of this order. -3- The Revision Petition stands disposed of in the above terms. |
