1. The complainant has invoked the jurisdiction of this Commission by filing the present complaint and raised a consumer dispute with regard to freezing her account by the OP and to pay/release the amount of Rs.14,86,584.60ps and to pay the compensation of Rs.3,00,000/- as well as litigation expenses of Rs.33,000/-.
2. Notice was issued to the opposite party and on 19.02.2021 Sh. Bharat Bhushan Sharma, Advocate appeared on behaved of OP and filed regular power of attorney written statement along with affidavit on behalf of OP on 10.03.2021. The OP denied the allegations levelled in the complaint by stating that the account was freezed by retaining the amount of Rs.14,86,584.60 due to mater subjudice in the Civil Courts. The OP denied any deficiency in service on its part and also prayed for dismissal of the complaint
However, on 06.12.2023, settlement has been effected between the parties and the parties has produced on record the attested to be true copy of agreement/memorandum of understanding/compromise as Ex.CX. Pursuant to the same, complainant has suffered a statement that the matter has been compromised with his brother Paramjit Singh and litigation pending between him and his brother has already been withdrawn from the respective courts. Further, he got recorded his statement that for withdrawing the present complaint in view of the compromise but with the request to direct the OP Bank to defreeze his account.
Sh. B.B. Sharma, Advocate counsel for OPs has got recorded his statement that since the matter has been compromised by the complainant with her brother Paramjit Singh on whose complaint the account of the complainant was freezed. So, the bank will abide by the orders passed by this Commission in this regard. Complainant has prayed for passing of award in view of the compromise.
3. In view of the aforesaid settlement arrived between the parties, the present complaint stands disposed of with the direction to the OPs to defreeze the account of the complainant within 15 days from the date of receipt of copy of order. Copy of the order be supplied to the parties free of costs.
4 . File be indexed and consigned to record room.
