C.C. No.63 of 2019                Darshana Devi Vs. PNB Met Life & Ors.        

Present:     None for the complainant.

Mr. Rohit Goswami, counsel for Mr. Vibahv Jain, counsel for the opposite party.         

        

                   Today, this complaint case is fixed for recording of evidence of complainant. Nobody has appeared on behalf of complainant.

2.                Perusal of complaint file reveals that; complaint case is lingering on for evidence of complainant since last many dates. First effective date for this purpose was 16.12.2019. Thereafter, it was adjourned to 12.02.2020, then to 29.04.2020. Note: because of Covid-19 pandemic, complaint case could not be taken up 29.04.2020, 10.08.2020, 27.10.2020, 13.01.2021. It was taken up for hearing on 26.03.2021. Then it was adjourned to 11.08.2021 for evidence of complainant. On 11.08.2021, 22.01.2022 matter could not be taken up due to Covid-19 Pandemic. It was taken up on 21.07.2022 and adjourned to 12.10.2022 for evidence of complainant. On 12.10.2022, on request of complainant it was adjourned to 16.01.2023, then to 04.04.2023, (which was a gazette holiday) then to 10.08.2023,, then to 02.11.2023, then to 22.01.2024 and finally for today i.e.12.04.2024 for the purpose of evidence of complainant. Notably, 22.01.2024 and 12.04.2024 (i.e. today) were the last opportunities for purpose of recording evidence of complainant. It is also apparent from record that on 02.11.2023, 22.01.2024 also nobody had appeared on behalf of complainant and position is none better today in this regard as nobody has appeared on behalf of complainant, despite that complaint was called twice.

3.                In wake of above facts, this Commission is satisfied that good numbers of effective opportunities have already been availed by complainant for leading evidence, but no evidence is forthcoming till now. Therefore, this Commission does not find any justifiable reason to adjourn the case for the same purpose, again and again.

 

4.                It is clear from above scenario of facts apparent on record that complainant is not earnestly interested any more, to pursue her case further, by leading evidence. It is already 1:30 P.M. Waited sufficiently. No further wait is justified. So, present complaint case in hand is hereby dismissed in default, for want of prosecution. It is ordered accordingly.  File be consigned to the record room.
