ORDER

1.      Perusal of the order sheet shows that the petition is pending since 2013. It further transpires that the respondent has already expired and this fact is in the knowledge of the petitioner at least since 11.02.2020. Time and again opportunity has been provided to move an appropriate application for the substitution of legal heirs but the same has not been availed.  The Order dated 31.08.2022 may be quoted hereinbelow:

In the Order dated 11.02.2020, it has been recorded that the Respondent, Mr. Piare Lal Verma has expired on 08.05.2019 and the death certificate as also been furnished. However, the Petitioner has not filed an Application to bring on record the Heirs and Legal Representatives of the deceased Respondent. As prayed by Mr. Alok Sangwan, learned Counsel for the Petitioner an Application for bringing on record the Heirs and Legal Representatives of the deceased Respondent, Mr. Piare Lal Verma be filed within three weeks. List on 14.10.2022.

2.       Thereafter the matter was listed on several dates.  The last Order dated 07.06.2023 reads as follows:

Adjournment sought on behalf of the Petitioner. The matter is adjourned to 31.08.2023. Meanwhile, last opportunity is given to the Petitioner to comply with the directions dated 31.08.2022, failing which the Revision Petition be dismissed for non-prosecution.

3.       Today proxy counsel has appeared on behalf of the petitioner and submits that the details of the legal heirs could not be availed and, therefore, appropriate application in that regard could not be filed. Adjournment has once again be sought to give further opportunity. It is also requested that the matter may be adjourned sine die.

4.       It appears that the matter has not been taken up in right earnest and this is clearly a case of non-prosecution.  The matter stands dismissed as such.     

5.       The Registry is requested to send a copy each of this Order to all parties in the petition. The stenographer is requested to upload this Order on the website of this Commission immediately.
