25/06/2008 Complainant: -IP Opposite-Party: -IS O.P.1 & O.P.2 Perused the complaint and documents. The opposite parties have filed memo on 11/6/2008 stating that, he has supplied the Gas Cylinder to the complainant along with acknowledgement. The complainant approached the Forum on the ground that the opposite party has not supplied the Gas Cylinder on the ground that he had refused to purchase the rubber tube. But after appearance of the opposite party before this Forum the matter was settled amicably and we directed the opposite parties to supply the Gas Cylinder to the complainant and accordingly, the opposite parties supplied the Cylinder to the complainant. The complainant also admitted that, he has received the Cylinder from the opposite parties. So, in view of the settlement the matter has been closed. However, the opposite parties cannot insist the complainant to purchase rubber tube. The opposite parties cannot put a precondition for supplying Gas Cylinder to the customers. The complainant is ready to take the risk there is no rule that rubber tube shall be purchased from the opposite party company itself. Therefore, the opposite parties shall not insist the consumers should purchase rubber tube from them only. With this observation since the matter has been amicably settled and the complainant has got relief. Therefore, the complaint is liable to be dismissed of as settled between the parties. Hence, the complaint is disposed of as settled. MEMBER MEMBER PRESIDENT
