The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986.  The

facts as alleged in the complaint are that he has purchased Philips LED TV Model NO. 39PFL3850/V7A11  for a sum of Rs. 26,500/- from OP-2 on 01.12.2016 with three years warranty. On 07.08.2018 the LED developed fault and was not functioning properly as there was no display of picture on its screen and complainant lodged complaint no. DEL0808180279 on 08.08.2018 with customer care of OP-1 who is the manufacturer. It is alleged after delay of three days that is on 11.08.2018 MR. Naveen from OP-3 authorized service center visited the premises of the complainant and after inspection told the complainant  that there was issue in display of the T.V. and the side panel button was also not working properly  and that the  T.V. set had to be taken to its workshop for caring out the repairs and demanded a sum of Rs. 945/- as loading charges. It is alleged that the complainant protested that as the product in dispute was under warranty and OP-2 never informed about such charges at time of purchase. It is alleged that Mr. Naveen told the complainant that in first year of warranty no loading charges was levied but thereafter the customer had to pay loading and other charges, therefore, the complainant under compulsion had to pay a sum of Rs. 945/- and was assured that the parts would be made available within 2-3 days from OP-1 and would be rectified thereafter within 2-3 days. Despite repeated requests to the OPs the Led T.V. was not repaired till date. Due to defective LED T.V. the complainant and his family suffered  mental harassment and agony. 

          Therefore, the complaint was filed before  this fora by the complainant with directions to OPs  either to replace the LED or refund the cost of LED.

Notice was sent to all the OPs but despite notice none put in appearance. During course of submission the complainant submitted at bar that he has received 70% of invoice amount of the product in dispute on 29.12.2018. He submitted that the amount was refunded after approximately three months and averred that the dispute only remained for the remaining 30% of the amount and for compensation on account of harassment. The LED in dispute was purchased on 01.12.2016 and it developed fault on 07.08.2018 after approximately two years. The complainant has used the product without any defect for approximately more than two years. Hence the OP has rightly depreciated the invoice amount but the complainant none the less faced mental and physical harassment for approximately three months whereby the OPs failed to provide the services as per the terms and conditions of warranty and it took nearly three months to refund the depreciated cost of the T.V. in dispute for which we feel that the complainant should be reasonably compensated. In order to meet the ends of justice we pass an award of Rs. 5,000/- in favour of complainant  and against OPs  towards  harassment and litigation expenses.
