[1]       Present appeal is pending since 1999.  It was lying on sine-die list.  It was taken out and notices were issued to both the parties.  Notice issued to the appellant is duly served.  Notice sent to the respondent no.1 and 2 are returned back.  Report of the notice sent to the respondent no.3 is not available.   Appellant has preferred to remain absent in spite of receipt of notice.  It is not desirable to prolong the matter when appellent is not interested.  Hence, appeal is dimissed in default.  Parties to bear their own costs.
