ORDER
DISTRICT CONSUMER DISPUTES REDRESSAL COMMISSION: NORTH-EAST
The Complainant has filed the present complaint under Section 35 of the Consumer protection Act, 2019.
The case of the Complainant as revealed from the record is that the Complainant purchased splendour pro-motorcycle bearing Regn. No. DL-5SAQ-5780 dated 07.06.2015 from the Opposite Party No. 1 on finance and paid total 19 EMIs in this regard. After that Complainant went to the office of Opposite Party No. 2 after receiving final demand notice dated 09.02.2017 and gave two EMIs of Rs. 5,748/- dated 14.02.2017 and 24.02.2017 according to the commitment for NOC. Complainant already submitted all the requisite payment to the office of Opposite Party No. 2 for releasing the NOC, but Officials of Opposite Party No. 2 always made lame excuses on one pretext or another. Both the Opposite Parties were in collusion and connivance with each other had been harassing to the Complainant by not taking proper action in respect of releasing the NOC as per the terms & conditions of policy. Opposite Parties had not only indulged in deficiency in services besides indulged in unfair trade practice by acting dishonestly to take undue advantage of the Complainant. The Complainant has prayed that Opposite Parties be directed to give No Objection Certificate or in the alternative to pay sum of Rs. 20,000/- jointly or severally to the Complainant towards the suitable compensation along with amount for the loss damages/compensation etc. on account of mental pain, agony, financial loss, harassment and on account of the unfair trade practice as well as deficiency in service on the part of the Opposite Parties and also directed to Opposite Parties to pay the litigation expenses to the tune of Rs. 25,000/-.
We have heard the Ld. Counsel for the Complainant on the point of Admission and we have also perused the file. The case of the Complainant is that he had paid all EMIs and clear requisite payment to the Opposite Party against the loan taken by him. In spite of that Opposite Party are not issuing NOC to the Complainant.
As per document submitted by the Complainant along with complaint there is a balance of Rs. 1,400/- to be paid by the Complainant to the Opposite Party as on 30.09.2019. Complainant has failed to produce any document of payment of Rs. 1,400/- to the Opposite Party.
In view of above, we did not see any ground to admit the complaint. The complaint is dismissed.
