1. Complainant is aggrieved that the assembled computer purchased from opposite party on 02-4-2009 became defective. It is his case that the monitor has 3 years warranty and one year free service for the computer was also offered. But opposite party did not rectify the defects or replace the product even after informing the defects.

2. Notice was issued to opposite party which was received by opposite party. The acknowledgement card returned to the Forum bears the signature and seal of opposite party shop. Opposite party remained absent and was set exparte on 26-10-2009. Complainant filed affidavit on 12-11-2009 restating the averments in the complaint. Ext.A1 establishes the value of the whole computer system to be Rs.34,000/-. There is no contra evidence adduced on the side of opposite party. Claim proved by the affidavit and document. Hence complaint allowed and opposite party is ordered to refund the amount of Rs.34,000/- (Rupees Thirty four thousand only) to the complainant along with costs of Rs.1,000/- (Rupees One thousand only) within one month from the date of receipt of copy of this order. On payment complainant shall return the full product (computer) to the opposite party.
