Case record is put up today. On perusal of the case record we find that a petition has been filed in this case by the Prasant Kumar S/o Surender Prasad resident of Bada Nimdih chaibasa stating there in that complainant of this case is his elder brother and at present he is Languish in jail in connection with criminal offense i.e in POCSO Act and he has given him direction to withdraw the case. Complainant's name in this. Case is Sumant Kumar S.o Surender Prasad Resident of Bara Nimdih Chaibasa and in this regard photocopy of the Aadhaar card has been filed which shows that petitioner is brother of the complainant. Further petitioner Prasant Kumar is present and submitted that there is no possibility in near future regarding release of his brother from jail cum today and further step can also not been taken in this case as he is doing job elsewhere . So this case may be disposed off.

Since Complainant is at present not in a position to conduct the case and further keeping in view the submission of complainant's brother we are of the view that this case should be dismissed as with drawn with liberty to file a fresh case when complainant is out of judicial custody today. Accordingly instant case is dismissed as withdrawn with liberty to file fresh case if required in future. When compliant is released from judicial custody.
