Daughter of the petitioner/complainant was selected by the respondent Institute for admission.  She deposited a sum of Rs.85,500/- on 9.3.2007.  Subsequently, she was selected for MBA Course of Jamia Hamdard  University.  Without attending any of the classes of the respondent institute, a request was made for refund of the entire amount.  Respondent refunded a sum of Rs.65,000/- after deducting Rs.20,000/- towards administrative expenses.  Aggrieved against this, petitioner filed a complaint before the District Forum.

-2-

District Forum allowed the complaint and directed the respondent to pay a sum of Rs.20,000/- along with interest at the rate of 9% per annum from March, 2007 till realization.

Respondent filed an appeal before the State Commission which has been accepted.  The order of the District Forum has been set aside.  The State Commission has concluded that the respondent was justified in retaining the sum of Rs.20,000/- towards administrative expenses which they must have incurred in the admission process.

We agree with the view taken by the State Commission.              3/4th of the amount deposited by the petitioner has already been released to the petitioner.  Rs.20,000/- were retained by the respondent as expenses incurred towards the process of admission.  No merits.  Dismissed.
