Girdhar Gopal vs. Pawan Electronics.

 

Present:None for complainant.

           

         Today the case is fixed for filing correct address of JD by the DH.  Earlier the execution was fixed on 12.12.2016 for filing the correct address of JD but the same was not filed; hence, the execution has repeatedly been adjourned for filing the correct address till today. Execution petition called several times since morning but neither the DH nor his counsel has put in appearance. Let the present execution petition be called again after lunch break.

            Execution petition called again after lunch break but neither the DH nor his counsel has put in appearance.  Waited sufficiently. It is already 3.40 P.M. No intimation regarding absence of DH is received.  From the perusal of the execution file, it reveals that the DH also did not appear on 21.6.2018 and today on 2.8.2018.  The present execution petition pertains to the year 2016 and the DH is not furnishing the correct address of JD.  So, it seems that the DH is not serious in pursuing the execution petition. Thus, the present execution petition is hereby dismissed in default.  However, it is made clear that the DH is at liberty to file the fresh execution petition as and when he is able to trace out the correct address of JD.  File be consigned to the record-room after due compliance.
