During the course of his submissions in furtherance to the directions contained in the previous Order dated 04.12.2019, learned counsel for the appellant builder co. requested for a brief interlude to seek instructions. 2. After seeking instructions, learned counsel for the appellant builder co. submits that, on instructions obtained from the level of Mr. Rajiv Jain, Director of the appellant builder co., the appellant builder co. wishes to unconditionally withdraw its instant appeal no. 1641 of 2019. 3. Learned counsel for the appellant builder co. further submits, on instructions obtained from the level of Mr. Rajiv Jain, Director of the appellant builder co., that the award made by the State Commission vide its Order dated 30.05.2019 will be complied with in its entirety within a period of eight weeks from today, without fail. 4. It is directed that the latter submission, recorded in para 3 above, shall in no way prejudice or impede the right of the respondent / complainant to press execution, both for ‘Enforcement’ under section 25(3) and for ‘Penalties’ under section 27(1) of the Act 1986. The State Commission shall forthwith undertake execution as per the law for compliance of its Order dated 30.05.2019 in its entirety. 5. Having regard to the submission recorded in para 2 above, the instant appeal no. 1641 of 2019 is dismissed as withdrawn without the option to file it again before this Commission. |
