This appeal has been filed against the judgment of the learned DCF, Jaipur 2^nd dated 22.1.2016.

The contention of the appellant is that his contempt petition has been dismissed summarily. The court should have ordered for possession of the plot.

 

Heard the counsel for the appellant and perused the impugned judgment .

 

There is no dispute about the fact that on 17.4.2015 the District Forum has ordered for the possession of Plot No. 5 & 6 but the settlement was entered between the parties out of the court and possession of Plot No. 7 & 8 were handed over. Now the appellant wants the contempt proceedings to be initiated against the respondent for Plot No. 7 & 8 which was not the subject matter of the original complaint and even on 17.4.2015 the order was passed only in relation to Plot No. 5 & 6. Hence, the District Forum has rightly considered the rival contention and dismissed the contempt petition.

 

There is no merit in this appeal and liable to be rejected.
