Today none has appeared on behalf of the appellant inspite of several calls.

A perusal of the order sheet has revealed that a court notice was issued to the appellant intimating him about the date of hearing, but inspite of court notice (paper Nos. 71 & 72) the appellant has not appeared before this Commission, whereas an associate Sh. Arvind Singh Rawat of senior counsel Sh. J.M. Singhal for respondent has appeared.

In such circumstances, it appears that the appellant is not willing to contest his appeal.

Hence, in the absence of the appellant, the appeal is hereby dismissed.  No order as to costs.

Original record be remitted back to the concerned District Commission with the copy of this order for perusal and necessary information.

                       File be consigned to the record room alongwith copy of this order.
