Heard petitioner in person. The factual backgrounds are that petitioner, for issuing of a passport, approached respondent No. 1. However for delay in receipt of police verification report, the passport could not be issued in time though shortly after receipt of police verification report passport was issued. The petitioner alleging deficiency on part of respondents took recourse to consumer fora filing a complaint. However, District Forum having taken notice of a decision of National Commission in case of Ved Prakash Vs UOI & Anr. [OP 78/95 (NC)] that the matter of issuance of passport being not a consumer dispute, consumer fora had no jurisdiction to adjudicate the issue, dismissed the complaint. Though appeal was preferred before State Commission, he having failed to participate, in proceedings suffered dismissal of appeal in default.

 

2.          Having gone through the finding of the District Forum which is based on a decision of National Commission, we concur with the finding and accordingly finding no merits, dismiss the revision petition.
