Counsel for the petitioners present.  Respondent Mr. Pasika Sampath Reddy in person alongwith his friend Sh. T. Sreeramulu, who can understand English language.  This appeal was dismissed in default on 05.03.2012 by the State Commission.

Arguments heard.  In the interest of justice, we restore the case before the State Commission subject to the petitioner remitting a sum of Rs. 5,000/- as cost to the respondent directly by way of demand draft till the next date of hearing.  It is also mentioned here that the respondent is handicapped. The second condition is that the 50% of the decretal amount already deposited with the District Forum, be released in favour of the respondent on his furnishing indemnity bond against some surety stating that in case the respondent loses the case, he will return the money to the District Forum. 

Parties are directed to appear before the State Commission on 16.08.2012.  State Commission is directed to hear the case on merits after satisfaction that the cost stands paid to the respondent.

The revision petition stands disposed of.
