The case is called out.
Sri Vineet Kumar, learned counsel for the Revisionist appeared.
The instant revision petition has been filed against the order dated 30-05-2023 passed by the Learned District Consumer Commission, Meerut in Complaint Case No. 98 of 2023. The order dated 30-05-2023 passed by the Learned District Consumer Commission, Meerut is quoted hereinbelow:-

पत्रावली पेश हुई। विद्वान अधिवक्तागण उभयपक्ष को निषेधाज्ञा प्रार्थना-5सी व 12सी और विपक्षी की आपत्ति कागज सं.-18सी पर सुना गया। परिवादी ने 5सी व 12सी प्रार्थना पत्र इस आशय के दिये हैं कि विपक्षी द्वारा सेवा में कमी व लापरवाही करते हुए जारी वसूली के नोटिस अंकन-26,13,615/- रूपये को स्थगित किया जाये। विपक्षी ने आपत्ति करते हुए यह कहा है कि परिवादी का विद्युत कनेक्शन 25 किलोवाट भार का था,

जो दिनांक 02.08.2022 को स्थायी रूप से विच्छेदित हो चुका है और उसने बिल का भुगतान नहीं किया है। इसलिए उक्त वसूली को रोके जाने का कोई पर्याप्त आधार नहीं है। परिवादी को विद्युत बकाया के कारण दिनांक 04.03.2023 को अंकन – 26,13,615/- रूपये की वसूली हेतु नोटिस जारी किया गया है और परिवादी का विद्युत कनेक्शन दिनांक 02.08.2022 को स्थायी रूप से विच्छेदित हो चुका है। परिवादी पर विद्युत बकाया शेष है। ऐसी स्थिति में उक्त वसूली को रोके जाने का प्रथम दृष्टया कोई औचित्य नहीं है। पत्रावली वास्ते साक्ष्य परिवादी दिनांक 27.07.2023 को पेश हो।”
It is submitted by the learned counsel for the revisionist that the electricity connection of the revisionist has been permanently disconnected by the Opposite Party/U.P. Power Corporation in the month of May, 2017 and thereafter the revisionist is producing the electricity by means of Generator Set.
Admittedly the electricity connection for 25 K.V. was sanctioned by the opposite party in favour of revisionist’s commercial establishment in the year 2012. In the impugned order, the Learned District Consumer Commission had categorically recorded that the permanent disconnection of the electricity was done by the opposite party only on 2nd of August 2022. It appears that from alleged date of disconnection in the month of May 2017 till the actual permanent disconnection i.e. till 2nd of August 2022, the electricity charges are not paid by the revisionist and against the

recovery of the impugned demand of electricity dues, the complaint has been filed before the Learned District Consumer Commission in which the order impugned has been passed.
Having heard the learned counsel for the revisionist, I do not find any irregularity or illegality in the impugned order particularly where the electricity dues are ordered to be recovered.
Accordingly, the revision petition is dismissed.
