ORDER

This revision petition has been filed by the revision petitioner/opposite party against order dated 13.06.2018 passed by District Consumer Disputes Redressal Forum-I, U.T., Chandigarh (in short ‘the Forum’) vide which, exparte proceedings were ordered against the revision petitioner/opposite party for not putting in appearance on the date fixed.

2.             Alongwith the revision petition, an application for condonation of delay has also been moved, as per which, there is a slight delay of 20 days as per the revision petitioner/opposite party (as per office 18 days) in filing the revision petition.

3.             Notice of the application aforesaid and revision petition be issued to the respondent/complainant.

4.             At this stage, Sh. Devinder Kumar, Advocate has put in appearance and accepts notice of application for condonation of delay and revision petition on behalf of the respondent/ complainant. Copies of revision petition and documents annexed therewith have been supplied to him.

5.             Heard on the application for condonation of delay.

6.             For the reasons stated in the application, which is supported by a duly sworn affidavit and finding sufficient cause, the delay aforesaid is condoned.

7.             The application is disposed of accordingly.

8.             It is stated by the Counsel for the revision petitioner/opposite party   that reply and evidence/affidavit is ready and it will be filed in the Forum within 10 days from today.

9.             Counsel for the respondent/complainant took up a very fair stand stating that let the complaint be decided on merits.

10.           We appreciate the view expressed by the Counsel for the respondent/complainant.

11.           Accordingly, the revision petition is allowed. Order dated 13.06.2018, under challenge is set aside. The revision petitioner/opposite party shall file reply and evidence/affidavit before the Forum within 10 days from today, failing which, no further opportunity shall be granted for the said purpose.

12.           Order passed in subject to payment of cost of Rs.4,000/- by the revision petitioner/opposite party to the respondent/complainant on the next date of hearing fixed before the Forum i.e. 30.10.2018.

13.             Parties are directed to appear before the Forum concerned on 30.10.2018.

14.           Complete record of complaint file be sent back to the Forum concerned alongwith certified copy of this order, so as to reach there before the date fixed.

15.           Certified copies of this order be sent to the parties, free of charge.

16.           File be consigned to the Record Room after completion.
