Service is complete.

2.           Sh. Mrigank Sharma, Advocate has put in appearance on behalf of respondent No.1/complainant by filing his memorandum of appearance, which is taken on record.

3.           This revision petition has been filed by the revision petitioner/Opposite Party No.5, against the order dated 20.03.2018 passed by District Consumer Disputes Redressal Forum-I, UT, Chandigarh (in short ‘the Forum’ only), vide which, Opposite Party No.5 was ordered to be proceeded against exparte. The said order was passed when the revision petitioner/Opposite Party No.5, despite issuance of notice, failed to put in appearance.

4.           The complaint is now fixed before the concerned Forum on 31.07.2018.

5.           At the time of arguments, Sh.Mrigank Sharma, Advocate, Counsel for respondent No.1/complainant states that he has objection in case, the complaint is ordered to be heard on merits. We appreciate the stand taken by Counsel for respondent No.1/complainant.

6.           In view of above, the revision petition is allowed. Order, referred to above, is set aside.

7.           Counsel for the revision petitioner undertakes to file reply and evidence/affidavit within 15 days from the date of putting in appearance before the Forum, failing which, no further opportunity shall be granted and the order dated 20.03.2018 passed by the Forum shall be deemed to have been affirmed, dismissing this revision petition.

8.           Parties are directed to appear before the concerned Forum on the date fixed i.e. 31.07.2018.

9.           Order passed is subject to payment of Rs.5,000/- as cost. Let amount of cost be paid by the Counsel for the Revision Petitioner to respondent No.1/complainant on the next date before the Forum.

10.         Certified copies of this order be sent to the parties, free of charge.

11.         Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.

12.         File be consigned to the Record Room after completion.
