Miscellaneous Application No.148 of 2024 has jointly been filed on behalf DH and JD for recording of settlement and for taking Memorandum of Understanding (MOU) on record.
2. Heard on above-mentioned application Miscellaneous Application No.148 of 2024. Keeping in view its contents; same stands allowed and Memorandum of Understanding (MOU) of February-2024 entered into between parties is taken on record. Both the parties would be bound by said Memorandum of Understanding. Miscellaneous Application No.148 of 2024 is hereby disposed off accordingly.
3. Mr. Suresh Kalia, counsel for the Decree Holder-complainant has suffered a statement that he may be permitted to withdraw the present execution application because matter has amiably been settled between both the parties in terms of Memorandum of Understanding (Annexure-A). His statement in this regard recorded separately.
4. Mr. Nikhil Sherawat, learned counsel for Judgment Debtor-opposite party has orally endorsed the correctness of statement of learned counsel for Decree Holder-complainant regarding amicable settlement of matter.
5. In view of statement suffered by Mr. Suresh Kalia, counsel for the Decree Holder-complainant, the present execution application is hereby dismissed as withdrawn.
6. A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be also uploaded forthwith on the website of the Commission for the perusal of the parties.
7. Application(s), pending, if any, stand disposed off accordingly in terms of this order.
8. File be consigned to record room alongwith a copy of this order.
