Half of the cost amount alongwith one post-dated cheque bearing No.050822 dated 29.10.2016 in the sum of Rs.1,20,338/-, towards TDS amount deducted have been handed over by the Counsel for Opposite Parties No.1 & 2 to the Counsel for the complainant. Copy of the aforesaid post-dated cheque has been retained on record.
Counsel for Opposite Parties No.1 & 2 undertakes that an amount of Rs.10,000/- shall be deposited in the Consumer Legal Aid Account in terms of order dated 01.08.2016 within a week’s time. After making the deposit, he will hand over copy of the receipt to the Reader of this Commission.
In order dated 01.08.2016, it was noted down that Judgment Debtors No.1 & 2 have handed over seven post-dated cheques to Counsel for the complainant to discharge their liability.
In view of above, Counsel for the complainant wishes to withdraw this complaint, with liberty to file a-fresh one claiming the amount due towards the principal amount, interest and also compensation under Clause 9(c) of the Flat Buyer Agreement dated 07.04.2008.
Liberty granted.
In view of above, the complaint stands dismissed as withdrawn.
The dispute qua Clause 9(c) of the Flat Buyer Agreement is kept open at this stage.
Certified copies of the order be sent to the parties free of charge.
