Today, in Court, four post-dated cheques bearing Nos.050872 dated 08.11.2016 in the sum of Rs.2,00,000/-, 050873 dated 14.11.2016 in the sum of Rs.3,00,000/-, 050874 dated 20.11.2016 in the sum of Rs.2,50,000/-and 050875 dated 20.11.2016 in the sum of Rs.24,263/-, totaling Rs.7,74,263/-, have been handed over by Counsel for Opposite Parties No.1 & 2 to the Counsel for the complainant. Photocopies of the aforesaid cheques have been retained on record.
It is stated by Counsel for Opposite Parties No.1 & 2, on getting instructions from Sh. Yudhvir Arora, Senior Manager (Legal), that on or before the due date, all the post-dated cheques will be replaced with demand drafts.
It is made clear that if any cheque is not so replaced and on presentation, the cheque is bounced, for each default the complainant will get compensation of an amount of Rs.20,000/- payable by Opposite Parties No.1 & 2.
With this payment, the complaint stands disposed of having been partly satisfied.
Liberty shall remain with the complainant to file it again when final order is passed by Hon'ble National Consumer Disputes Redressal Commission, New Delhi in Appeal Execution No.15 of 2015 titled ‘Parsvnath Developers Limited & Anr. Vs. Jyoti Sood & Ors.’.
Certified copies of the order be sent to the parties free of charge.
