Learned counsel for the parties are present.

      This is an appeal U/s 27A of C.P.Act in which the appellant/JDr has assailed order dated 6.12.2018 passed by the learned District Forum, Deogarh in Execution Case No. 01 of 2017 arising out of C.D.Case No. 2 of 2016.

      In course of hearing on admission, learned counsel for the appellant/J.Dr files a memo to the effect that the appellant is furnishing a cheque for Rs.60,000/- to be handed over to the respondent/DHr towards full and final satisfaction of the award sought to be executed by the learned executing Forum.

     Learned counsel for the respondent/ DHr receives the cheque, acknowledgement of which is endorsed in the memo.

     Learned counsel for the respondent/DHr, on instruction, submits that the respondent/DHr has accepted the cheque for Rs.60,000/- towards full and final settlement of the award sought to be executed before executing Forum and the respondent/ DHr has no objection to the prayer for dropping of the execution case.

    In view of the above, the appeal has become infructuous and is disposed of as such.

    Consequently, Execution Case No. 01 of 2017 arising out of C.D.Case No. 92 of 2016 pending before the learned District Forum, Deogarh is dropped. Learned District Forum is directed to recall NBW issued against the appellant/JDr.
