JUDGEMENT

1.         Facts of this appeal are exactly the same as were in First Appeal No. 63/2012. This is a counter appeal filed by the respondent therein i.e. Hyundai Motors Plaza. First Appeal No. 63/2012 was disposed of by this Commission vide orders dated 11.05.2016. No fresh pleas or arguments have been putforth in the present appeal.  In the circumstances, decision in the present appeal i.e. First Appeal No. 679/2011 shall remain the same as in First Appeal No. 63/2012 disposed of vide orders dated 11.05.2016. 
2.     Copy of the orders be made available to the parties free of costs as per rules and thereafter the file be consigned to Records.
3.     FDR, if any, deposited by the appellant be released as per rules.
