| Final Order / Judgement | Per Mr B A Shaikh, Hon’ble Presiding Member None for the appellant is present. Perusal of the record & proceedings of the appeals shows that Advocate Mr Mishra had appeared for the appellant lastly on 13.06.2017 and he had sought time for taking appropriate steps for service of notice to respondent No.3 as the notice issued to the respondent No.3 was returned un-served with postal endorsement as “Insufficient address”. Thereafter none appeared for the appellant continuously on three dates i.e. on 16.08.2017, 11.09.2017 & 06.11.2017. The appellant took no steps for service of notice to respondent No.3 and none appeared for the appellant in these three appeals. Therefore, on last date i.e. on 06.11.2017 these three appeals came to be adjournment till this date for appropriate order. The respondent Nos.1 & 2 are already proceeded exparte in all these three appeals. We, thus, find that since last three dates with effect from 16.08.2017 none appeared for the appellant in all these three appeals and sufficient address of the respondent No.3 is not provided for reissuing the notice to respondent No.3, all these three appeals deserve to be dismissed in default. Hence, these three appeals are dismissed in default. No order as to costs in these appeals. Copy of the order be furnished to both parties free of cost. | |
