ORDER

 

BY PRESIDENT THIRU. G.VINOBHA, M.A.,B.L.,

          This complaint is filed by the complainant u/s 12 of the Consumer Protection Act.1986.

          The complainant filed this complaint  against the opposite party  to repay Rs.63,600/- the amount due on FDR A/c.No.11316 with interest @ 12% from 01.06.00 till repayment and to repay Rs.68,320/- the amount due on FDR A/c.NO.6492 with interest @ 19% from 26.07.95 till repayment and to pay Rs.25,000/- for the deficiency of service committed by the opposite parties in failing to repay the money due with interest on the matured FDR and to pay Rs.50,000/- as compensation  for the resultant mental agony and paid caused by such deficiency of service and to pay Rs.5,000/-as cost of this complaint.

          Complainant  and opposite party absent inspite of notice sent to them by RPAD. No representation on either side. W.P.No.42787/2004 and W.P.35512/2004 already disposed by Hon’ble High Court of Madras on 02.08.2007 following a scheme for payment to all the depositors by the Park Town Benefit Fund by appointing a special officer for repayment of deposit amount to depositors.  The parties might have settled the matter as per scheme approved by company law board in C.P.No.91/2010.  Hence no interest in prosecuting this complaint before this commission.  No useful purpose will be served in keeping this matter pending.  Hence this complaint is closed.
