The present complaint is listed for admission on 18/10/2023.  It was heard, where the advocate of Complainant was heard at length. The main grievance is against State RTO (Regional Transport Authority) for not granting renewal of the permit as on page no.8 para-16.

                The Complainant is not a consumer within the Section 7(ii).  There is no relation as a service provider and consumer based on payment of fees and taxes; as per the Hon’ble State Commission SDRDC Madurai in CC/72/2014.  The payment of fees and taxes to a statutory authority does not constitute payment of consideration for a service. Such s in NCDRC Part I (1994) CPJ 99(NC), 1994 (I) CPR 87(NC) & Part II (1996) CPJ89.

                Therefore, the respondent no.2 cannot be held as service provider as submitted by Complainant on page no.6 para-10.

                As for respondent no.1, the statute of limitation applies as the date of purchase 27/02/2018 as submitted on the invoice. Hence the complaint is rejected on the stage of admission.
