          Heard.

          For the reasons stated in the application, the delay in filing the revision petition is condoned subject to payment of Rs.5,000/- as cost to be deposited with the Consumer Legal Aid A/c-NCDRC.

 

R.P. NO.3052 OF 2014

1.      This revision petition is directed against the order of the State Commission dated 03-04-2014 whereby the appeal preferred by the petitioner against the order of the District Forum dated 25-11-2008 was dismissed.

2.      The grievance of the petitioner is that the impugned order passed by the State Commission is not a speaking order since it does not refer to the pleas taken and the contentions raised by the parties at the time of hearing of the appeal. On perusal of the impugned order, we find that it does not deal with any of the contentions raised by the petitioner-board in the appeal which it had filed against the order of the District Forum dated 25-11-2008. The order also does not refer to the contentions, if any, advanced by the complainant/respondent in support of the said order dated 25-11-2008. Therefore, we set aside the said order and remit the matter back to the State Commission with a direction to pass a speaking order in the appeal filed by the petitioner-board i.e. Appeal No.87 of 2009, referring to and dealing with the contentions raised by the parties at the time of hearing of the appeal. Ordered accordingly.        The parties shall appear before the State Commission on           18-12-2014. The revision petition stands disposed of accordingly. A copy of this order be given dasti to the parties.
