ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:
JUDGMENT
Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;
“Direct the opposite party to pay compensation of Rs.19,70,000/- towards for mental agony, expenditure, cost of litigation , loss of business/financial loss”.
Brief fact of the case is that complainant being a member of Truck Owner Association being deprived of getting proper Cargo/loading/business has filed the consumer complaint but there is no document attached with the consumer complaint or filed any receipt regarding payment of consideration amount.
Relationship between complainant and opposite party is that of Association and Member and no consideration amount paid to get service. So complainant cannot be termed as a consumer as defined U/s.2(7) of Consumer Protection Act, 2019. Hence we find no merit in the consumer complaint and accordingly the consumer complaint is dismissed. No cost.
