This appeal has been filed against the order passed by the District Forum, Dausa dated 9.12.2016 whereby the claim has been allowed against the appellant.

The contention of the appellant is that he has not charged money twice for compulsory checking. On 12.10.2015 Rs. 75/- were charged for two years for necessary checking but on 19.11.2015 money was charged for the repair of the burner but the consumer has put fake seal on the receipt. Hence, the claim should have been disallowed.

 

Heard the counsel for the appellant and perused impugned judgment as well as documents submitted by the appellant.

 

In receipt dated 12.10.2015 Rs. 75/- has been charged for two years compulsory checking. On 19.11.2015 also Rs.75/- has been charged for two years compulsory checking and the seal has been put to the above effect. Now the contention of the appellant is that bill dated 19.11.2015 was for repairs of the burner but this fact has not been mentioned in the receipt. If this receipt was issued in lieu of repair charges then there must be an endorsement of such effect. Hence, the appellant has tried to make a false case before this Commission.

 

There is no merit in this appeal not worth admission and looking at the fact that a false plea has tried to be raised, the

appeal is dismissed with Rs.5000/- cost which should be paid to the respondent within one month failing which it carry 9% interest till the date of payment.
