The complainant’s case is as follows: The respondents approached the complainant and told that they are accepting deposits and promised to give interest for the deposit or will return the double amount of deposit after 5 years. Believing the words of the respondents the complainant had deposited Rs.5,000/- in the 1st respondent firm on 1/1/2003. The respondents promised to return Rs.10,000/- on 1/1/2008. He approached the respondents on 3/1/08 for the return of the deposited amount. But not returned the amount as promised. A lawyer notice was sent on 10/1/08 demanding the same. But not returned so far. Hence the complaint.
2. The respondents are called absent and set exparte.
3. To prove the case of the complainant he filed an affidavit and produced Exhibits P1 to P4 series.
4. According to the complainant, he had deposited Rs.5,000/- in the respondent firm on 1/1/03 upon the promise made by the respondents that they will return back double amount of it after 5 years. But the respondents did not return the deposited amount after the due date.
5. There is no evidence to the contrary.
6. In the result the complaint is allowed and the respondents are directed to return the Exhibit P1 amount with 12% interest from 2/1/08 till realization and also to pay Rs.500/- as costs within one month from the date of receipt of copy of order.
