SRI.K.T.SIDHIQ: PRESIDENT:

The case of the complainants are that  they availed Neethi gas connections through opposite party No.1 on deposit of approximately ` 8000/-each.  But when the complainants wished to surrender the said connections  opposite parties informed them that only ` 2500/ -each will be refunded. Hence the complaint praying for an order against opposite parties for the refund of deposited amount with compensation.

2.   Notice issued  to opposite parties served.  But they remained absent represented.  Hence name of opposite parties called absent and set exparte.

3.  Complainant No.1  examined as PW1 and Exts A1&A2, LPG consumer books marked.

During evidence, PW1 deposed that he did not remember the exact amount  deposited at the time of  availing  gas connection.  He further stated that he did not aware   that  ` 5750/- is the security deposit as  contended by the 2nd opposite party in other cases.  Therefore we are of the view that  the complainants are entitled  only for ` 5750/- each.

Hence the complaint is allowed and opposite parties are jointly and severally  directed to refund `  5750/- each  to the complainants within one month from the date of receipt of copy of order.  Before receipt of payment the complainants  shall surrender the gas cylinder and regulator to the opposite party No.1 and obtain the  surrender certificate. If iopposite parties failed to refund the amount within one month then the  amount of `  5750/- will carry interest @9% from the date of complaint till payment.
