          The case of the complainant is as follows.

          The complainant had purchased a double door refrigerator of 333 litres from the 2^nd opposite party which was manufactured by the 1^st opposite party on 21/08/2017 for an amount of Rs.36,500/- as after deducted the exchange bonus and other offers.  But within a short period after its purchase the refrigerator having no effective cooling.  The complainant approached the 2^nd opposite party alleging the improper cooling.  The 2^nd opposite party and the 1^st opposite party had not taken any steps for rectifying the defects of the refrigerator.  The 1^st and 2^nd opposite party sent technicians for checking the refrigerator.  But the alleged defects was not rectified by anybody.  There was clear deficiency in service from the side of the opposite parties.  Hence this complaint.

          The notices were served with the opposite parties.  They did not appear either in person or through their counsel even after accepting the notice from this Forum.

          The complainant filed proof affidavit and documents which are marked as Exts. A1 and A2 and he was examined as Pw1.

          Heard complainant.  We have gone through the complaint, proof affidavit and documents.  The case of the complainant stands unchallenged by the opposite parties even after accepting the notice from this Forum.  So we have no reasons to disbelieve the sworn proof affidavit and documents produced by the complainant.  Hence we are of the opinion that the case of the complainant is to be allowed.

          In the result, the complaint is allowed as follows.

1. We ordered opposite parteis to pay Rs.36,500/- (Rupees Thirty six thousand only) as the price of the refrigerator and pay Rs.1,500/- (Rupees Thousand and five hundred only) (ie. Exchange value of the old fridge) to the complainant and pay Rs.2,500/- (Rupees Two thousand and five hundred only) as compensation for inconveniences and pay Rs.2,500/- as costs of these proceedings. 

The Order shall be complied with within a period of one month from the date of receipt of a copy of this Order.The Order not complied within one month, the amount will carry interest @ 10% per annum from th2e date of Order till payment.
