Today is fixed for showing cause by the Complainant as to why the present complaint shall not be dismissed for non-prosecution.
Today also the complainant has not taken any step. None appears on behalf of the complainant on repeated calls.
It is evident from the record that this complaint was filed on 29.12.2017 and the complaint was admitted on 05.01.2018 and notice was issued to the O.P. No. 1 and 2 on 08.01.2018 by this Office through Speed Post. The notice upon O.P. No. 2 returned without service with note ‘Left’. So the complainant was directed to take fresh steps upon O.P. No. 2 for service of notice. Thereafter, complainant by filing a petition stated that the notice has been served upon the O.P. No. 1. But complainant did not take any step afresh for service of notice upon O.P. No.2.
It is found from the record that the complainant did not take any steps for service of notice upon O.P. No. 2 and files petition for another date on 16.04.2018. On the next date that is 11.05.2018 complainant was found absent and no step taken afresh for service of notice upon O.P. No. 2. So the complainant was directed to show cause as to why the present complaint shall not be dismissed for non-prosecution.
Today also the complainant is found absent and no step taken on his behalf. Therefore we have no other option but to dismiss the complaint for non- prosecution.
Hence, it is
O r d e r e d
that the Consumer Complaint being No. 258/2017 be and the same is dismissed for non-prosecution against the O.Ps. There is no order as to costs.
Let plain copy of this order be supplied to the complainant free of cost as per provisions of law.
