          The case of the complainant Sri Chandi Prasad Dutta, in short, is that one WB-34AB/3814 Palco Automobiles chassis and engine (nature of particular vehicle is not stated) was purchased at 51,387/-(Fifty one thousand three hundred eighty seven) only on 26/09/12.  Within first year the vehicle was given service twice at the rate of 15/-(Fifteen) only per service.  The reason for such charge 15/- (Fifteen) only was not given to the complainant against assurance of free service.  Stating the allegation the complainant came before us with a prayer for compensation of 15,000/- (Fifteen thousand) only.

          The Op contested the case by filing written objection that there is no cause of action and jurisdiction for filing this case.  The allegation is denied with explanation that in support of keeping good condition of the Hero Honda, the manual servicing charge at the rate of 15/- (Fifteen) only for every service has taken by them. So there is no deficiency of service and as such the case should be dismissed.

Decision with reasons :

            We are to decide the question whether the Op is entitled to collect 15/-(Fifteen) only for each service of the vehicle during first one year free service w.e.f. the date of purchase.  In this subject, there is no material evidence  forthcoming from the end of the Op since it is admitted case of the Op that they have accepted 15/-(Fifteen) only   on the plea of service charge on two occasions from the complainant during first one year of Free service from the date of purchase.  If that be so, we do not find any good meterial to accept the case of the Op., rather there is clear admission of the fact that they have taken the charge as alleged both complainant showing documentary evidence to that effect.  As a result, the prayer should be allowed. Now, considering the allegation, it is justified and reasonable to fix an amount of compensation of 2,000/-(Two thousand) only payable by the Op. in favour of complainant.    

               Hence, it is,

                                    Ordered,

                                                    that the case be and the same is allowed  on contest  without cost.

The complainant do get compensation of 2,000/-(Two thousand) only payable by the OP Palco Automobiles within 30 days.
