ORDER

Order

1. Complainant   has moved application under section 340 Crpc for lodging a complaint against S. Manmeet Singh, the chief executive Officer Palm Tree Hotel to prosecute U/s 193 IPC on the allegations of filing the tax invoice annexure 2 with supplementary affidavit   after filing tax invoice annexure 3 on the ground of its being a false and fabricated document.
2. Op has filed  objection stating that the complainant was not charged even a single rupee in excess to the tariff etc.
3. Heard the parties and pursed the record.
4. The main case is pending and is not decided so far. The conclusion of document being a false and fabricated cannot be arrived at without passing judgment. At this stage application is premature and is liable to be rejected.
5. Application U/s 340 Cr.P.C. is hereby rejected.
