O R D E R     

            Sh. Sanjeet Singh herein the complainant has brought the present complaint U/s 12 of the Consumer Protection Ac. 1986 against Paladin System Pvt. Ltd.(Home Service) and Vodaphone Store  herein after referred as the opposite parties.

            The brief facts of the present complaint as stated  are that the complainant on 1.3.15 purchased one mobile APPLE IPHONE 6 from Jai Sachidanand Mobile Store for sale consideration of Rs. 58200/- vide invoice No. RI/14-15/8718 dated 1.3.15.              On the same day he insured the mobile handset for one year with the opposite party No.1 on payment of Rs. 58,20/- as premium.   On 6.4.15, the mobile handset was stolen.   The police failed to recover the mobile handset.  He lodged FIR No. 419 dated 6.4.15 with Police Station, Janak Puri, N. Delhi.   The SHO of  P.S : Janak Puri has submitted un-trace report of theft of the mobile handset before the Area Metropolitan Magistrate.     The complainant submitted claim of the stolen mobile handset with opposite party No.1.   But they rejected his claim.    Hence, the present complaint for direction to the opposite party No.1 to pay the insured amount of Rs. 58,200/- with compensation and cost of litigation.

 

            Notice of the complaint was sent to the opposite parties.     But despite service none appeared  on behalf of the opposite parties.   Therefore, the  opposite parties were proceeded ex-parte vide order dated 9.11.15.

 

            When the complainant  was asked to lead ex-parte evidence he submitted his affidavit.   Wherein he once again reiterated the facts of the complaint.   The complainant also relied upon photocopies of the invoice No.               RI /14-15/8718 dated 1.3.15, certificate issued by opposite party No.1, FIR No.419 dated 6.4.15, un-trace report submitted by the SHO of PS : Janak Puri dated 28.4.16 U/s 173 Cr. P.C and  complainant dated 6.4.15  on which FIR No. 419 dt. 6.4.15 U/s 379 IPC is registered in Police Station, Janak Puri, N. Delhi.

            We have heard the complainant in person and have gone through the complaint, invoice, protection plan certificate, FIR and un-trace report dated 28.4.15 carefully and thoroughly.

 

            From Perusal of affidavit of complainant and documents  relied upon by him it reveals that the complainant vide invoice No.RI/14-15/8718 dated 1.3.15  purchased a mobile handset from Jai Sachidanand Mobile Store for sale consideration of Rs. 58200/-.   He insured the mobile handset with opposite party No.1 on payment of premium of Rs. 5820/-on the same day for one year.    The mobile handset was stolen on 6..4.15.   The complainant lodged FIR No. 419 dated 6.4.15 U/s 379 IPC in Police Station, Janak Puri, New Delhi.   The police of PS, Janak Puri failed to recover the mobile handset.   Therefore, the SHO of P.S, Janak Puri submitted un-trace report before Addl. Chief Metropolitan Magistrate, Tis Hazari Court, Delhi

 

                        The version of the complainant, affidavit, invoice, protection plan, FIR and un-trace report dated 28.4.15 have remained un-rebutted and unchallenged.  Therefore, there is no reason to disbelieve  the same.   Hence, from un-rebutted and unchallenged evidence the complainant succeeded in proving  that on 1.3.15 he purchased a mobile handset from Jai Sachidanand Mobile Store for sale consideration of Rs. 58,200/- vide  invoice No.   No.RI/14-15/8718 dated 1.3.15.  On the same day he insured the mobile handset with opposite party No.1 for one year on payment of Rs. 5820/- as premium.   The mobile was stolen on 6.4.15 within

the insured period.    The complainant lodged FIR No.  419 dated 6.4.15 in PS : Janak Puri, N. Delhi.   The mobile is not traced by the police.   The SHO, PS : Janakpuri has submitted un-trace report  to the Area Metropolitan Magistrate.     The complainant filed claim with the opposite party No.1.  The opposite party No.1 failed to pay compensation of the stolen mobile handset being insurer.  Hence, there is deficiency of service on the part of opposite party No.1. Therefore, the opposite party No.1 is liable to indemnify the insured of cost of the mobile handset.    

 

            Therefore, we direct the opposite party No.1 to pay a sum of Rs. 58,200/- as cost of the mobile handset + Rs. 5820/- amount of insurance  premium totalling Rs. 64020/- with interest @ 9% P.A. from the date of filing of the present complaint till actual realisation of the amount and Rs. 11,000/- as compensation towards mental pain agony, suffering and litigation expenses to the complainant.

 

Order pronounced on   : 28.5.2016
