All these appeals raised common question of law hence, are decided by this common order.

 

The contention of the appellant is that they are not deficient as after audit report , demand has rightly been raised.

Per contra the contention of the respondent is that demand is time barred.

 

Heard the counsel for the parties and perused the impugned judgment as well as original record of the case.

 

The similar controversy has already been decided by this Commission in First Appeal No.885/2016 A.En. (O & M) Ajmer Vidyut Vitran Nigam Ltd. Vs. Rahamatullah and the matters are squarely covered .

 

Hence, in view of the above all these appeals are allowed and the order of the Forum below is set aside.
