The case of the complainant in brief is that the o.p. is a business institution carrying on different business viz. Pailan Gems & Jewellery Ltd. and Pailan Park Diamond Abasan Ltd. The o.p. sometime floated product purchase scheme. In the year 2013 the complainant started to deposit Rs.1600/- and Rs.500/- respectively for a period of 12 months and the complainant was assured to get the entire amount together with interest @ 14% and the complainant went on depositing the said scheme and in such manner complainant deposited Rs.12,100/- for the two policies. After maturity whenever the complainant demanded the said amount and the pass book was collected by the agent from the complainant and after handing over the pass book after some time it was found that no entry was made in the pass book. The complainant on query came to learn the maturity amount would be credited shortly in favour of the complainant. After maturity the complainant approached the branch of o.p. and found that the office was closed. The complainant tried to realize the said amount from the o.p. but became in vain. In view of the said fact the complainant has prayed for refund of deposited amount of Rs.9600/- and Rs.2500/- plus 14% interest and compensation of Rs.10,000/- and litigation cost of Rs.5000/-.
O.p. has not appeared and the case has proceeded ex parte against the o.p.
In support of the contention of the complaint, the complainant files some documents wherefrom it is found that the complainant invested the amount of Rs.9600/- and Rs.2500/- in respect of two policies being no.PDO1441345 and PGO 1516421. It is also found from the materials on record that the complainant demanded the money after the maturity period, but o.p. did not give any response to the demand made by the complainant.
In view of the facts and circumstances as stated above, we hold that the complainant will be entitled to get the deposited amount of Rs.9600/- and Rs.2500/- respectively together with interest @ 14% per annum and also a compensation of Rs.10,000/- for harassment and mental agony and litigation cost of Rs.2000/-.
Hence, it is ordered,
That the C.C. No.304/2015 is allowed on contest with cost against the o.p. O.p. is directed to pay to the complainant a sum of Rs.9600/- (Rupees nine thousand six hundred) only and Rs.2500/- (Rupees two thousand five hundred) only respectively together with interest @ 10% per annum and is further directed to pay compensation of Rs.10,000/- (Rupees ten thousand) for harassment and mental agony and litigation cost of Rs.2000/- (Rupees two thousand) within 30 days from the date of communication of this order, i.d. an interest @ 10% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
Supply certified copy of this order to the parties free of cost.
