Desai No. 885, 6th Cross, 6th Block Koramangala Club Road Koramangala Bangalore 560 095 Complainant V/S 1. Pai International Electronics Ltd. No. 28/1A, 100 Feet Road Indiranagar, Bangalore 560 038 2. IFB Industries Ltd. Plot No. IND 5, Sector 1 East Calcutta Township Calcutta 700 078 Opposite Parties ORDER By the President Sri. S.S. Nagarale Complainant present. The learned advocate for the opposite parties also present. 2. At the time of hearing the learned advocate for the opposite parties fairly and rightly submitted that opposite parties are ready to get the repairs done to the washing machine at their own cost and the opposite parties are also ready to give further warranty for six months. To this proposal the complainant who was present before the open court submitted that she is ready to accept the proposal offered by the opposite parties and she has no objection whatsoever to repair the washing machine and to make it defect free and in running condition and she will co-operate with the opposite parties during the time of repairs. The complainant further submitted that the opposite parties may be directed to give one year warranty instead of six months offered by the opposite parties. The submission of the complainant on the facts and circumstances of the case is quite justified, proper and reasonable. Consumer Protection Act is a social and benevolent legislation intended to protect the better interests of the consumers. Consumer is a most important visitor in the premises of the opposite parties. Consumer is not dependent on the opposite parties / service provider. On the other hand the service provider is dependent on consumer. It is the duty and obligation of the opposite party company to supply defect free goods to the satisfaction of purchasers. The request of the complainant for giving one year further warranty is quite reasonable, fair and proper. The opposite parties will not be put to any hardship or inconvenience or loss in giving further warranty of one year. Therefore, taking into consideration of the submissions made I proceed to pass the following: ORDER 3. The Complaint is allowed. The opposite parties are directed to get the repairs done from the qualified mechanic or service engineer to the washing machine at their own costs. 4. The opposite parties are further directed to give further warranty for one year. The complainant shall co-operate with the opposite parties in execution of repair work. 5. The opposite parties are directed to comply the order within four weeks from the date of this order and report the matter to this forum. The complaint is disposed off accordingly. 6. Send the copy of this Order to both the parties free of costs immediately. 7. Pronounced in the Open Forum on this 20TH DAY OF DECEMBER 2008.
