The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant, who purchased a Videocon Split A.C. Machine at a price of Rs. 24,500/- on 12-06-2012 and the same being a faulty one, has prayed for replacement of the same or refund of the purchase money and for compensation of Rs. 1,50,000/- together with Rs. 10,000/- litigation costs. 2. The o.p. nos. 3, 4 & 5 in their written version denied the material allegations made in the complaint and contended interalia that the A.C. machine though developed fault in cooling the atmosphere after purchase and the same was removed. So the case should be dismissed. 3. Notices were served upon the O.Ps. But the S/R of O.P. nos. 1 & 2 was not received. So the case was heard ex parte against o.p. nos. 1 & 2. 4. Upon pleadings of both parties two points arose for determination : i) Is there any deficiency in service on the part of the O.Ps. ? ii) Whether the complainant is entitled to get any relief as prayed for ? DECISION WITH REASONS : 5. Both the points are taken up together for consideration. Admittedly one 1.5 ton Split A.C. Machine being no. VS 5B3. WVI-MIRA 3 Star WHT was purchased from the O.P. no. 1 for a sum of Rs. 24,500/- on 12th June, 2012. Admittedly, the A.C. Machine developed fault since April, 2013 rendering the cooling effect to zero level. On request, the O.P. no. 2 tried to sort out the defect. But within one week i.e., on 1st week of May, 2013 the machine developed the same cooling problem. It is really frustrating as because, the complainant purchased the A.C. Machine for cooling the room temperature. If by spending huge money, the machine turns to be defective, the complainant is undone. The O.Ps. turned deaf ear to his subsequent requests. On scrutiny of the enclosures we are of the view that this is a fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of. Hence, O R D E R E D That the C. C. Case No. 178 of 2013 ( HDF 178 of 2013 ) be and the same is allowed on contest as against the O.P. nos. 3, 4 & 5 with costs and ex parte against O.P. nos. 1 & 2 without costs. The O.P. nos. 3, 4 & 5 be directed to refund the purchase money of Rs. 24,500/- to the complainant within 30 days from the date of this order The complainant is entitled to a compensation of Rs. 5,000/- for causing mental pain and prolonged harassment from the o.ps. The complainant is further entitled to a litigation cost of Rs. 3,000/- from the O.P. nos. 3, 4 & 5 within 30 days from the date of this order. .
