JUDGMENT

The appellants are the opposite parties in CC.1/09 in the file CDRF, Palakkad.  The appellants are under orders to pay a sum of Rs.5000/- as compensation and Rs.1000/- as cost.

The matter is with respect to the missing of the original R.C of the vehicle of the complainant which was entrusted with the opposite parties for effecting transfer of ownership.  It is the case of the complainant that subsequently after about one year duplicate of RC was given.

It was the contention of the opposite parties that original RC was handed over to the complainant and subsequently on application the duplicate was also issued on 30/1/2009.

The evidence adduced consisted of proof affidavit of the respective parties and Exts.A1 to A3.

The Forum has disbelieved the case set up by the opposite parties as they could not produce any acknowledgement with respect to the handing over of original RC to the complainant or application for duplicate RC.  On a perusal of the order of the Forum we find that there is no scope for admitting the appeal.

In the result the appeal is dismissed in-limine.

The office will forward a copy of this order to the Forum urgently.
