Order no.  21

The record is place before me today.

On perusal of the record, I find that vide letter no.1314(2)/SC/2J-05/2011 dated 24.09.2013 the Hon’ble SCDRC, West Bengal communicated its order no.13 dated 19.08.2013 to this Commission.

It appears from the record that vide order no.14 dated 13.08.2010 the Commission had been pleased to dispose of the case as not maintainable with a liberty to file the same afresh before the appropriate Forum within one month from the date of order. Being aggrieved, the complainant preferred First Appeal before the Hon’ble SCDRC West Bengal. Thereafter as per direction of NCDRC the said First Appeal was renumbered as CC/76/2012 by the Hon’ble SCDRC, West Bengal.

Thereafter, the dispute was resolved amicably between the parties out of the Court and the Hon’ble SCDRC vide order no.13 dated 19.08.2013 disposed of CC/76/2012 as per agreement between the parties. The said order has not been placed in record since 24.09.2013.

However it is apparent on the face of the record that the dispute between the parties had amicably settled out of the Court and CC/76/2012 filed by the complainant before the Hon’ble SCDRC, West Bengal had been disposed of on 19.08.2013.

Therefore the instant CC/09/289 has become in fructuous and stands disposed of.
