JUSTICE SHRI.K.R. UDAYABHANU : PRESIDENT
The appellants are the opposite parties/Southern Railway in CC.23/2007 in the file of CDRF, Malappuram. The appellants are under orders to pay a sum of Rs.1500/- towards loss of articles sent through railways and Rs.6000/- as compensation and Rs.1000/- towards cost.
2. It is the case of the complainant that 10 bundles of household articles were dispatched from Himachal Pradesh to Kuttipuram and the bundles except three were received at the Kuttipuram Railway station on different dates. The booking was on 10..3..2004. The bundles were delivered on 16..5..2004, 4..6..2004 and 31..3..2004. The loss of 3 bundles of household articles is admitted. The Forum by directed to pay Rs.1500/- towards the cost of three bundles. It is towards compensation for mental agony and hardships that Rs.6000/- is ordered to be paid. The Forum has noted that the complainant had to wait anxiously for the delivery of each bundle whereas the bundles ought to have reached the destination at the same time. The complainant had claimed a sum of Rs.20,000/- as compensation.
In the circumstances we find that the order to pay Rs.6000/- as compensation cannot be said to be excessive. We find no reason to interfere. The appeal is dismissed in-limine.
